Key Details Explained

Fact: The OBBB Act does NOT eliminate the tax on Social Security benefits directly. The old rules for calculating how much of your benefit is taxable are still in place.

Instead, the Act creates a new, separate $6,000 deduction ($12,000 for a qualified joint couple) that lowers your overall income. For some middle-income retirees, this deduction is large enough to reduce their total taxable income to zero, indirectly making their benefits tax-free. It provides no benefit to the lowest-income seniors (who already owe no tax) or the highest-income seniors (who are phased out).

As of 2025, most states do not tax Social Security. However, nine states still do, though most have income exemptions that protect many retirees. These states are:

  • Colorado
  • Connecticut
  • Minnesota
  • Montana
  • New Mexico
  • Rhode Island
  • Utah
  • Vermont
  • West Virginia (phasing out)
